ArtMento Terms of Service

Effective Date: March 15 2026

Welcome to ArtMento. These Terms of Service ("Terms") govern your use of the ArtMento mobile application, website, and related services (collectively, the "Services").

By creating an account or using the Services, you agree to these Terms. If you do not agree, please do not use ArtMento.

1. Overview of the Service

ArtMento is a platform designed to help users learn and practice visual art through:

• AI-powered art mentorship
• AI-generated reference images
• guided art exercises
• community sharing of artwork
• critiques and creative discussions

ArtMento is intended to support artistic exploration and learning.

2. Eligibility

You must be at least 13 years old to use ArtMento. If you are under 18, you must have permission from a parent or legal guardian. You agree that the information you provide during registration is accurate and current.

3. User Accounts

To access certain features, you may be required to create an account. You are responsible for:

• maintaining the confidentiality of your login credentials
• all activity that occurs under your account
• notifying us immediately if you believe your account has been compromised

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

ArtMento allows users to upload, generate, and share creative content including:

• artwork
• sketches
• paintings
• reference images
• comments
• critiques

This content is referred to as "User Content."

5. Ownership of Artwork and Creative Content

You retain full ownership of the artwork and creative content you create or upload to ArtMento. By posting content on the platform, you grant ArtMento a non-exclusive, worldwide, royalty-free license to:

• display your content within the app
• operate community features
• promote the platform (for example, featuring artwork inside the app)

This license exists only for the purpose of operating and improving the Services. ArtMento does not claim ownership of your artwork.

6. AI-Generated Content

ArtMento may generate reference images or other content using artificial intelligence systems. You acknowledge that:

• AI-generated outputs may be imperfect or inaccurate
• similar outputs may be generated for other users
• generated content may resemble existing artworks or images

ArtMento does not guarantee the originality, accuracy, or suitability of AI-generated outputs. Users are responsible for how they use generated content.

7. AI Mentor Chatbot

ArtMento includes an AI mentor chatbot that provides information and guidance related to art and creative practice. The AI mentor:

• does not provide professional instruction or certification
• may produce responses that are incomplete or incorrect
• should not be relied upon as professional advice

Users should use their own judgment when applying artistic guidance.

8. Community Guidelines

To maintain a positive environment, users agree not to post or share content that:

• is abusive, threatening, or harassing
• contains hate speech or discrimination
• is sexually explicit or pornographic
• promotes violence
• violates intellectual property rights
• violates any law or regulation
• impersonates another person

ArtMento reserves the right to:

• remove content
• suspend accounts
• restrict community access

if these guidelines are violated.

9. Intellectual Property Rights

The ArtMento platform, including its design, software, logos, and content (excluding User Content), is owned by ArtMento or its licensors and is protected by intellectual property laws. You may not:

• copy
• distribute
• reverse engineer
• modify

any part of the Services without permission.

10. Prohibited Uses

You agree not to use the Services to:

• exploit or harm minors
• attempt to gain unauthorized access to systems
• distribute spam or malicious content
• interfere with the operation of the platform
• scrape or extract large amounts of data

Violation of these restrictions may result in termination of your account.

11. Account Termination

We may suspend or terminate accounts if users:

• violate these Terms
• abuse the community
• attempt to disrupt the platform

Users may also delete their accounts at any time. Active subscriptions should be cancelled before account deletion. Termination may result in removal of stored content.

12. Third-Party Services

ArtMento may rely on third-party providers to operate the platform, including:

• cloud hosting providers
• AI processing services
• analytics services

These providers operate under their own terms and policies.

13. Disclaimer of Warranties

The Services are provided "as is" and "as available." ArtMento makes no guarantees regarding:

• uninterrupted access
• error-free performance
• accuracy of AI-generated outputs
• suitability of artistic advice

Use of the Services is at your own risk.

14. Limitation of Liability

To the maximum extent permitted by law, ArtMento shall not be liable for:

• indirect or consequential damages
• loss of data
• loss of artwork
• damages resulting from reliance on AI outputs
• disputes between users

Our total liability shall not exceed the amount paid by you to use the Services in the preceding 12 months.

15. Indemnification

You agree to indemnify and hold harmless ArtMento from any claims arising from:

• your use of the Services
• your User Content
• your violation of these Terms
• your infringement of intellectual property rights

16. Changes to the Service

We may modify, update, or discontinue features of the Services at any time. We will attempt to notify users of significant changes.

17. Changes to These Terms

We may update these Terms periodically. Continued use of the Services after updates constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by the laws of the United States and the State of Georgia, without regard to conflict of law principles. Any legal disputes shall be resolved in the courts located in Georgia.

AI-Generated Content and Intellectual Property Clause

20. AI-Generated Images and Creative Outputs

ArtMento provides tools that allow users to generate images and visual references using artificial intelligence systems ("AI-Generated Content"). You acknowledge and agree that:

1. AI outputs are generated algorithmically based on user prompts and machine learning models and may produce results that are similar to images created by other users or third parties.
2. ArtMento does not guarantee that AI-generated images are unique, original, or free from potential copyright claims.
3. AI-generated images are intended to serve as creative reference material and artistic inspiration, and users are responsible for how they use such content.
4. ArtMento makes no representation or warranty that AI-generated content will not infringe upon the intellectual property rights of any third party.

21. User Responsibility for Use of Generated Content

Users are solely responsible for how they use AI-generated images produced through the Services. This includes responsibility for:

• publishing generated images
• incorporating generated references into artworks
• commercial use of generated images
• distributing generated images outside the platform

Users agree not to knowingly generate or distribute content that infringes on the intellectual property rights of others.

22. Prompt Responsibility

Users agree that prompts submitted to generate AI content will not:

• intentionally replicate identifiable copyrighted works
• request reproduction of specific copyrighted artworks
• attempt to mimic identifiable artists in a deceptive manner

ArtMento reserves the right to restrict or moderate prompts that violate these guidelines.

23. No Ownership Claim Over AI Outputs by ArtMento

Unless otherwise specified, ArtMento does not claim ownership over AI-generated images created by users through the platform. However, due to the nature of generative AI systems:

• identical or similar outputs may be generated for different users
• ArtMento cannot guarantee exclusivity of generated content

24. Copyright Complaints and Content Removal

ArtMento respects the intellectual property rights of others. If you believe that content available on ArtMento infringes your copyright, you may submit a copyright complaint including:

• identification of the copyrighted work
• identification of the allegedly infringing content
• contact information
• a statement of good faith belief that the use is unauthorized

ArtMento may remove or disable access to content that is alleged to infringe intellectual property rights.

25. Limitation of Liability for AI Outputs

To the maximum extent permitted by law, ArtMento shall not be liable for claims arising from:

• the generation of AI images
• similarity between generated images and existing artworks
• user use of generated content outside the platform
• alleged copyright infringement involving AI-generated outputs

Users assume full responsibility for their use of generated images.

26. Indemnification Related to Generated Content

You agree to indemnify and hold harmless ArtMento from any claims, damages, or disputes arising from:

• your prompts submitted to generate images
• your use or distribution of AI-generated images
• any alleged infringement resulting from your use of generated content.

Art Style Imitation and Artist Attribution Clause

27. Artistic Styles and AI-Generated Images

ArtMento's AI systems may generate images that reflect general artistic techniques, aesthetics, or visual characteristics associated with broader artistic traditions or movements. Users acknowledge and agree that:

1. Artistic styles are often defined by shared techniques, visual language, and historical influences, and the generation of images inspired by broad artistic traditions does not imply reproduction of any specific artwork.
2. ArtMento does not intentionally replicate or reproduce specific copyrighted artworks through its AI image generation tools.
3. Due to the nature of generative AI systems, images produced by the Services may occasionally resemble the style, technique, or aesthetic associated with particular artists.
4. ArtMento does not represent that AI-generated images are created by, endorsed by, or affiliated with any artist or estate.

28. Prohibition on Misrepresentation

Users agree not to:

• represent AI-generated images as works created by a specific real-world artist
• falsely attribute generated content to identifiable artists
• use generated images in a manner that misleads others regarding authorship or origin.

Any such misrepresentation may result in removal of content or suspension of the user's account.

29. Artist Respect Policy

ArtMento is committed to supporting and respecting the global community of artists. The platform is designed primarily to:

• generate reference images for learning and practice
• support artistic education
• inspire creative exploration

ArtMento does not encourage or support the misuse of AI tools to exploit or impersonate the work of identifiable artists.

30. Moderation of Prompts and Content

ArtMento reserves the right to:

• restrict prompts that explicitly request imitation of identifiable living artists
• remove content that violates these Terms
• modify system behavior to reduce misuse of the AI image generation tools.

DMCA Copyright Policy and Safe Harbor Notice

31. Copyright Protection

ArtMento respects the intellectual property rights of others and expects users of the Services to do the same. ArtMento complies with the Digital Millennium Copyright Act (DMCA) and will respond to properly submitted notices of alleged copyright infringement. If you believe that content available through ArtMento infringes your copyright, you may submit a DMCA takedown notice as described below.

32. Filing a DMCA Takedown Notice

To submit a copyright infringement claim, please provide a written notice containing the following information:

1. Identification of the copyrighted work claimed to have been infringed.
2. Identification of the material that is claimed to be infringing, including information reasonably sufficient to allow ArtMento to locate the material (such as a URL or description of the content).
3. Your contact information, including:
   • full name
   • mailing address
   • email address
   • telephone number
4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
5. A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
6. Your physical or electronic signature.

33. Response to Copyright Notices

Upon receiving a valid DMCA notice, ArtMento may:

• remove or disable access to the allegedly infringing material
• notify the user who posted the material
• take additional action as appropriate under the law.

ArtMento reserves the right to remove content that allegedly infringes copyright without prior notice.

34. Counter-Notification Procedure

If you believe that your content was removed in error or misidentification, you may submit a counter-notification containing:

1. Identification of the material that was removed and its location before removal.
2. A statement under penalty of perjury that you have a good faith belief that the material was removed due to mistake or misidentification.
3. Your name, address, and telephone number.
4. A statement that you consent to the jurisdiction of the federal court in your district (or where ArtMento operates).
5. Your physical or electronic signature.

Counter-notices should be sent to:

ArtMento may restore the removed content if the original complainant does not file a court action within the timeframe required by law.

35. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, ArtMento has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. ArtMento may:

• suspend accounts
• remove content
• restrict platform access

for users who repeatedly violate copyright laws.

36. Good Faith Requirement

Submitting false copyright claims or misrepresenting infringement may result in liability under U.S. law. Users are encouraged to ensure that their claims are accurate before submitting a DMCA notice.

37. Artificial Intelligence Training and System Improvement

ArtMento uses artificial intelligence technologies to provide features such as:

• reference image generation
• AI mentor responses
• exercise recommendations
• platform improvements

These systems may be developed using a combination of:

• publicly available data
• licensed datasets
• internally generated data
• algorithmic training methods

ArtMento does not claim that any specific user content was used to train any particular AI model.

Use of User Interactions for Improvement

To improve the quality, safety, and reliability of the Services, ArtMento may analyze:

• anonymized usage patterns
• prompts submitted to the system
• chatbot interactions
• feedback about generated results

Where possible, this information is used in aggregated or anonymized form.

Opt-Out for Training Purposes

ArtMento does not use user-uploaded artwork to train external AI models without permission. If ArtMento ever introduces features that allow user artwork to contribute to AI model training, users will be provided with clear notice and the ability to opt out where applicable.

38. Community Artwork and Licensing Boundaries

ArtMento allows users to share artwork publicly within the community section of the platform.

Limited License to Display Content

By posting artwork or other creative content publicly on ArtMento, you grant ArtMento a limited, non-exclusive, royalty-free license to:

• display your artwork within the platform
• operate community features
• showcase artwork within the app interface
• feature artwork in curated galleries or educational examples inside the Services

This license exists solely for the purpose of operating and improving the platform. ArtMento does not acquire ownership of your artwork.

No Automatic License for Other Users

Unless you explicitly grant permission, other users do not receive a license to:

• reproduce your artwork
• sell your artwork
• distribute your artwork outside the platform
• use your artwork for commercial purposes

Users are expected to respect the intellectual property rights of other artists.

Community Interaction and Commentary

ArtMento allows users to comment on artwork and share critiques. Users agree that:

• critiques represent individual opinions
• ArtMento does not endorse or guarantee the accuracy of critiques
• users are responsible for respectful engagement in the community.

ArtMento reserves the right to remove comments or content that violate community guidelines.

Featuring Artwork

From time to time, ArtMento may feature artwork within:

• community highlights
• exercise examples
• educational materials within the app

When possible, ArtMento will provide artist attribution within the platform.
